These Terms of Service ("Terms") govern your use of flavourtheory.co.uk (the "Site") and any orders you place with us. Please read them carefully. By using the Site or placing an order, you agree to these Terms.
1. Who we are
"Flavour Theory", "we", "us" and "our" refer to Bean Theory Limited, a company registered in England and Wales (company number 14684599), with its registered office at Waresley Park Stud, Gamlingay Road, Waresley, Sandy, SG19 3DD. You can contact us at hello@flavourtheory.co.uk.
2. Using our Site
You may use the Site for lawful purposes only. You must not misuse the Site, attempt to gain unauthorised access, introduce malicious code, or use it in any way that could damage or impair it. We may suspend or withdraw the Site, or restrict access, at any time without notice; we don't guarantee that the Site will always be available or uninterrupted.
3. Eligibility
To place an order you must be at least 18 years old and legally able to enter into a contract. By ordering you confirm that the information you give us is accurate and that you're authorised to use the payment method.
4. Products and descriptions
We sell BBQ rubs, seasonings and related products, including custom blends you design in The Lab. We take care to describe and picture our products accurately, but:
- product images are for illustration; the natural colour, texture and aroma of spices can vary from batch to batch;
- because our blends are natural and made in small batches, slight variations between batches are normal and not a fault.
5. Allergens and food safety
Ingredients and allergen information are shown on each product page and on the product label. Our blends may contain or be made in a kitchen that also handles allergens including mustard, celery and other spices, so we cannot guarantee any product is free from cross-contamination. If you have a food allergy or intolerance, please read the ingredient and allergen information carefully before ordering, and contact us first if you're unsure. Nothing on the Site is intended as nutritional, dietary or medical advice. Always store and use products as directed on the label.
6. The Lab and custom blends
The Lab lets you design a bespoke rub by adjusting the flavour profile, and to name your blend. When you create a custom blend:
- you're responsible for the recipe and the name you give it. You must not use names that are offensive, unlawful, or that infringe anyone's trade marks, copyright or other rights;
- we may decline to produce, or may ask you to change, any blend name we reasonably consider offensive, infringing or otherwise inappropriate;
- custom blends are made to order and personalised, so they cannot be cancelled once production has started, and are not eligible for change-of-mind returns (see our Returns & Refunds Policy and clause 10).
7. Orders and how a contract is formed
When you place an order you're making an offer to buy. We'll send an order confirmation acknowledging we've received it — this does not yet form a contract. A binding contract is formed only when we send you a dispatch confirmation. We may decline or cancel an order (and will refund any payment) if, for example, the product is unavailable, there's an error in the price or description, we suspect fraud, or we're unable to fulfil it.
8. Prices and payment
All prices are shown in pounds sterling (GBP). Bean Theory Limited is VAT registered. Prices on the Site include any VAT that applies; many culinary seasonings are zero-rated for UK VAT, so the VAT charged on our rubs may be nil. Where VAT applies it is included in the price shown and itemised on your receipt.
Delivery charges are shown separately at checkout before you pay. We make every effort to ensure prices are correct, but if we discover an error in the price of items you've ordered we'll contact you to confirm whether you wish to continue at the correct price. Payment is taken securely through our checkout and payment providers at the time you order.
9. Delivery
Our blends are made to order; please allow 5–10 working days for delivery within the UK. Full details, costs and timescales are in our [Delivery Policy], which forms part of these Terms. Risk in the goods passes to you on delivery.
10. Cancellations, returns and refunds
Your rights to cancel, return and obtain refunds are set out in our [Returns & Refunds Policy], which forms part of these Terms. In summary: as our products are consumable food made to order, we don't accept change-of-mind returns, but if an item is faulty, damaged in transit, not as described or incorrect, you're entitled to a replacement or refund — please tell us within 14 days of delivery. This does not affect your statutory rights.
11. Promotions and discount codes
Any promotion, discount code or offer is subject to its own terms, may be withdrawn at any time, can't be used in conjunction with other offers unless stated, and has no cash value.
12. Accounts
If you create an account, you're responsible for keeping your login details confidential and for activity under your account. Please give accurate, current information and let us know if your details change.
13. Intellectual property
The Site and all of its content — including the Flavour Theory name and logo, text, images, design, "The Lab" tool and the flavour-wheel system — are owned by or licensed to Bean Theory Limited and are protected by intellectual property laws. You may not copy, reproduce, or use them without our prior written permission, except as needed to use the Site and place an order.
14. Your content
If you submit content to us (for example a blend name, a review, or a message), you grant us a non-exclusive, royalty-free licence to use it in connection with our business. You confirm that your content is your own (or you have the right to use it) and that it isn't unlawful, offensive or infringing. We may remove content at our discretion.
15. Our liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded by law — including your rights under the Consumer Rights Act 2015. Subject to that:
- we are not liable for losses that were not foreseeable, or for business losses (we supply to consumers for domestic and private use);
- our total liability arising from any order is limited to the price you paid for that order.
We're not responsible for failure or delay in performing our obligations caused by events outside our reasonable control (for example extreme weather, courier or supplier failure, strikes, or utility or IT failures). If such an event occurs we'll let you know and do what we reasonably can to minimise the effect.
16. Privacy
We handle your personal data in line with our [Privacy Policy], which explains how we collect, use and protect your information.
17. Changes to these Terms
We may update these Terms from time to time. The version that applies to your order is the one in force at the time you place it. The "Last updated" date above shows the current version.
18. Governing law and jurisdiction
These Terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales will have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
19. Complaints
We want you to be happy. If something's gone wrong, please contact us at hello@flavourtheory.co.uk and we'll do our best to put it right.
20. General
If any part of these Terms is found to be unenforceable, the rest will continue to apply. Our failure to enforce a right isn't a waiver of it. These Terms, together with our Delivery, Returns & Refunds and Privacy Policies, form the entire agreement between us regarding your use of the Site and your order.
